Welcome to the official Theo Early website. These Terms of Use govern your access to and use of www.theoearlymusic.com, including its pages, content, features, forms, and related services collectively referred to as the "Site."
The Site is operated by Theo Early. In these Terms, "Theo Early," "we," "us," and "our" refer to the operator of the Site.
By accessing or using the Site, you agree to these Terms. If you do not agree, you should not use the Site.
1. Purpose of the Site
The Site provides information and content related to Theo Early, including music, releases, videos, photographs, artwork, news, blog posts, merchandise, performances, booking information, and related promotional content.

"Theo Early" and associated names, logos, graphics, and branding may not be used in a manner that suggests sponsorship, endorsement, or affiliation without prior written permission.
4. Limited Personal-Use License
You may access and view publicly available Site content for your personal, noncommercial use.
Unless expressly authorized, you may not:
- Reproduce, republish, distribute, sell, license, or commercially exploit Site content;
- Modify or create derivative works from Site content;
- Upload or redistribute music, videos, artwork, photographs, or written content from the Site;
- Remove copyright, trademark, attribution, or rights-management notices;
- Use Site content to train, develop, evaluate, or improve an artificial-intelligence or machine-learning system;
- Use Theo Early's name, image, likeness, voice, music, or branding to falsely suggest endorsement or affiliation; or
- Use Site content for merchandise, advertising, promotion, impersonation, or commercial purposes without written authorization.
Limited automated access may be permitted when expressly authorized through the Site's published robots.txt, llms.txt, structured data, API documentation, or other written instructions. Such authorization does not transfer ownership or grant broader rights to the content.
5. Acceptable Use
You agree not to:
- Use the Site for unlawful, fraudulent, abusive, or deceptive purposes;
- Attempt to gain unauthorized access to the Site, its servers, accounts, databases, or connected systems;

6. Newsletter and Email Communications
You may voluntarily subscribe to receive announcements concerning new music, videos, merchandise, performances, news, promotions, and other Theo Early updates.
By subscribing, you consent to receive the types of emails described at the point of signup. Newsletter subscriptions are not required to access the Site or make a purchase.
You may unsubscribe at any time by using the unsubscribe link included in a marketing email or by contacting us at theoearly36@gmail.com.
Administrative responses, requested communications, purchase confirmations, or other transactional messages may still be sent when necessary.
7. Contact Forms and Communications
When you submit a contact, booking, press, collaboration, or similar inquiry, you represent that the information you provide is accurate and that you are authorized to provide it.
Do not use the contact form to send passwords, financial-account information, government identification numbers, medical information, or other sensitive information.
We are not obligated to accept, review, respond to, or pursue any proposal, collaboration, booking request, demo, creative idea, or other unsolicited submission.
Unless we expressly agree otherwise in writing:
- Your submission will not create a confidential, fiduciary, employment, agency, partnership, or contractual relationship;
- We may retain and review the submission for the purpose of evaluating or responding to it; and
- We are not obligated to compensate you for submitting an idea or proposal.
You retain ownership of materials you submit. You grant us a limited right to access, copy, and share those materials with appropriate representatives solely as reasonably necessary to review and respond to your communication.
8. Merchandise and Purchases
Merchandise may be offered through the Site or through a third-party storefront or fulfillment provider.
When products become available, additional terms may apply concerning:
- Product descriptions and availability;
- Pricing, taxes, and payment;
- Shipping and delivery;
- Returns, exchanges, and refunds;
- Preorders and limited-edition items;

We reserve the right to correct pricing or product-description errors, limit quantities, cancel fraudulent orders, and discontinue products, subject to applicable law.
Payment-card information may be processed directly by a third-party payment processor. Unless expressly stated otherwise, the Site does not directly store complete payment-card numbers.

A link or reference to a third party does not necessarily mean that Theo Early controls or endorses that third party.

The Site may link to or display content from services such as Spotify, YouTube, Instagram, TikTok, X, Facebook, ticketing platforms, or other external providers.
Your interaction with those services is governed by their own terms and privacy policies. Those providers may collect information or use cookies and similar technologies when their content is loaded or when you visit their services.
We do not control and are not responsible for the availability, accuracy, security, content, or privacy practices of external services.
11. Accuracy and Availability
We attempt to keep Site information accurate, but we do not guarantee that all content is complete, current, or error-free.
Release dates, performance dates, product availability, pricing, track information, credits, external links, and other information may change without notice.
We may modify, suspend, restrict, or discontinue any part of the Site at any time.
12. Copyright Concerns
We respect intellectual-property rights.

18. Governing Law and Venue
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
To the extent permitted by law, disputes arising from these Terms or the Site will be brought in the state or federal courts located in or serving Lucas County, Ohio.
This provision does not prevent consumers from exercising mandatory rights available under the laws of their place of residence.
19. Severability and Waiver
If a provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
20. Entire Agreement
These Terms, the Privacy Policy, and any additional policies or terms presented for a particular feature or transaction constitute the agreement between you and us concerning your use of the Site.
